Well, you definitely have to get your student loans took care of and back on track with paying. You will not be able to file those under the bankruptcy.

Depending on which state you live in, each state has a Statue Of Limitation's which means you can't be sued after so many years from the first time you went delinquent on payments which is 90 days with no payment. All states are either 2,4, or 6 years, I can tell you which yours is if you let me know which state you're from.

For example, if your state is 4 years, and it is passed the 4 years, they are unable to sue you EVER. After that time you don't LEGALLY own that debt anymore, but they can still try to call/mail or whatever they want to do, to try and recover that money from you. It's nothing a Phone number change won't fix though, to stop a life time of calls.

Never ever file bankruptcy unless you absolutely HAVE to. If you get sued over some 10k or 20k item then yeah that would be your best bet, because they would win and start detaching wages. Once you file bankruptcy your 7 years will start all over again from the day it goes through.

I a.ssume some of your debts you owe are older and may fall off in a few years which is way better than restarting the time line on everything by filing for bankruptcy.

How much are some of the debts you owe, and how long has it been since your last payment on them?

Good info again... I am in Pa and my bothersome debt is a HSBC low credit card. I maxed out the limit and the interest has piled on. My student loans is almost 5.5k It started out at almost 8k. Verizon, dentist, and a couple other collectors are sending overs to payoff but it's still a little bit hard for me. I say my total debt includes about 10 or 11 k. I have a car that I am paying on also. I am up to date on that.

I am thinking about contacting AES and see if I can get on some type of payment schedule. sh*t I should have been had this sh*t paid off. I forgot to mention in my previous post that Nationwide auto insurance tossed me to collections because I switched to another auto insurance. I've never heard of auto insurance companies doing that. Is that legal? I mean you pay for the insurance, I never was in an accident.

Rek I got a couple of questions.
Citibank Charged off my debt per the fair credit act in May of 09. It's still on my reports. How do I get this off?

I have two medical bills on there that went to collections, but I paid in full. How do I get these off the reports?

I have another medical debt on there that I have no idea who they are and they've never contacted me. It's only $100. How do I get this off?

I also seem to have a lot of inquiries racked up on my report. How do I get these off?

The Inquiries just have to fall off, every time you apply for credit or somebody checks your credit an inquiry will show up. They fall off in 2 years from the time they check your credit.

The 100 dollar debt you can have the 3 credit bureau's run a debt validation on that debt. Since you aren't sure who they are you just dispute it with the 3 credit bureau's and the reason will be to request a debt validation. If they cant provide proper paper work to them within 30 days they will delete it. If they do prove its your debt then you will know who its from and you can offer a Pay-For-Delete to the credit agency for the 100 dollar debt.

The 2 Medical Bills that you paid for in full are just going to have to wait out the 7 years now. Once you pay it off you have no leverage. That's where the "Pay-For-Delete" would've have came into play. They say to never ever ever pay off your debts unless you're going to be sued, once you do they got you for the whole 7 years. Even though its paid now, it still considered a negative.

The Citibank one you can either wait another 3.5 years for it to fall off and never worry about it. Or try a Pay-For-Delete letter as well with them, or whoever they've sold the debt to.

The Macy's card definitely leave open. It makes your total available credit a lot better against total borrowed credit. Helps out your debt to available credit ratio a lot. Thats a big factor on your score. Definitely leave it open.

Best thing you can do with late payments is call them up directly and ask them nicely to have them removed. I had a couple of mine removed by doing so back in the day. If you've been paying on time for a while now and its a thing of the past they will usually budge and remove them. Throw in a little sob story about how you came upon hard times and etc.. you know the drill there. If they don't budge you can always dispute it towards the 3 major credit bureau's. As I've heard of people having success with that if the first step don't work out.

Which ever you like really. Depends if you like the rewards type credit cards or not. Really just take which ever has the lowest interest rate. When you're ready just apply for the one you really want, instead of apply for a handful at once. You don't want all those inquiries on your report and I a.ssume you dont want a handful of cards anyway.

That APR is kind of high but it's a good off though take from someone that knows credit card debit will leave you fu*ked up if you can't make the payments though. I would just make small purchases and use for emergencies only.

After a while of making on time payment they will probably increase your credit limit idk b/c the credit laws changed in 2010. Just don't let your sh*t go into collections b/c they are going to double your debit. If the card is $500 then they will double it to a $1000 or maybe more depending on the credit limit you had.

My credit isn't necessarily bad but I still have a debt that I owe on that I've been trying to pay since 2009. When I tried to make arrangements to pay it I called to collector that I thought still had the account but they claimed they didn't have it anymore. When I asked them for contact information so I could make the arrangements that told me they didn't have any.

Now a yr & half goes by and I didn't receive any letters about this (but I knew that I still owe) then I get a letter from another company but I told them I was getting ready to move. Last year I moved and before I could even get settled in they start calling me again. I told them I would have it by the fall but I had some other issues that came up.

Another company started sending me letters about the same debt at the end of last year but I ain't called them yet b/c now I'm a have to move pretty soon and I just ain't have the money yet so I can call to see if I can make a one-time settlement. I just don't want to end up going to court and I want to make arrangements ASAP but my money is all tied up right now. I really don't know what to do.

Right now i have a 1000 debt that unfortunately went to collections. Im just not making enough money to make the payments that this collection agency wants. They call everyday asking for an 800 payment or RBC will take it to court.

By "falls off" I mean your negative credit will fall off your credit report after 7 years and good credit falls off after 10 years.


So lets say you owe 1,000 to a 4.5 year old debt. You can just wait 2.5 years and it will come off your credit report. Some people will pay these debts after those 4.5 years and its STILL a negative on your credit report even though its still paid and on top of that, it will start the 7 years back over because you paid it.


They will always threaten court. How old is your 1,000 debt that went to collection?

About half a year now...the debt got to 1000 around 2 months ago and sent to collections at the end of april.
So, its still pretty new then.

If you want to pay it instead of waiting 7 years and not paying it you can offer them a "Pay-For-Delete" which you agree to pay in full in return for deleting it off your credit report.

They could sue you between now and up until your states Statue Of Limitations kicks in, but I doubt it for 1,000 bucks, but you never know either. If you get sued by them at that moment you can just call them up and start making payments to avoid all that.

I know in my state the statue of limitation is 6 yrs on credit card debt. I opened the account in late '04-early 05 but they didn't put the sh*t into collections until '08. What I want to know is creditors wait that long to put it in collections? I just want to settle the account before the yr is over with.

Well the good thing is, the 7 years and your states 6 year Statue Of Limitations start from the moment you're delinquent on your account with no payment. Which would either be 90 or 180 days. You can report that as Obsolete to the 3 major credit bureaus and get that off if not right now, VERY soon.

When they sell off your account to collection agencies they still have to go by all the original dates of debt and everything that happened before they purchased it. Statue Of Limitations don't start over at that point.

Just remember either 90 or 180 days of no payment = Delinquency. That is the exact moment your Statue Of Limitations will start and your 7 year fall off date.
