1) bapestas came about when Nikes trade dress (different than trademark) for the AF1 expired

2) Bape is Japanese company completely different patent / IP laws

3) when Nike renewed the trade dress for the AF1, Bape changed their shoes to not violate the trade dress

What is trade dress?

Essentially if you take a product, in this case a shoe, with no branding on it just the shoe itself do they look the same
