The Supreme Court has overturned the landmark ruling Roe V Wade, eliminating nearly 50 years of constitutional protections for abortion.

The 5-4 decision will leave the issues of abortion up to state legislators, which will ultimately result in a total ban on the procedure in about half of the states.

Associate Justice Samuel Alito was joined in his opinion by Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.

In Friday's ruling, Alito called Roe "egregiously wrong from the start".

He said the Constitution "does not confer a right to abortion," declaring that the decision should ultimately be left to the state to regulate.

"Abortion presents a profound moral question The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion.

"Roe and Casey arrogated that authority. The Court overrules those decisions and returns that authority to the people and their elected representatives."

The states that may implement total or near-total abortion restrictions include Alabama, Arizona, Arkansas, Georgia, Idaho, Iowa, Kentucky, Louisiana, Michigan, Mississippi, Missouri, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, Wisconsin and Wyoming.

In a concurring opinion, Justice Thomas wrote that the Supreme Court should "reconsider the rulings that protect contraception, same-s*x relationships, and same-s*x marriage."

"In future cases, we should reconsider all of this Court's substantive due process precedents, including Griswold, Lawrence, and Obergefell.

"Because any substantive due process decision is 'demonstrably erroneous,' we have a duty to 'correct the error' established in those precedents," he wrote.

Democrat-appointed Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan dissented.

“With sorrow—for this Court, but more, for the many millions of American women who have today lost a fundamental constitutional protection—we dissent,” they wrote.

At the same time, the court voted 6-3 to uphold a Mississippi law that bans all abortion past 15 weeks, with very few medical exceptions.

President Joe Biden has been briefed on the decision and is expected to address the nation later today.

Told these people, the trump presidency was going to resonate for more than just 4 yrs…. Probably the next 30 to 50 years we’ll be feeling the results of having a Supreme Court that is heavily right, and unqualified judges that never did case law.

I guess when an abortion case is challenged at the state level, this decision could ultimately impact the outcome. Depends on the states since each have different legislation pertaining to this issue. I could be mistaken.

Alabama, Arizona, Arkansas, Michigan, Mississippi, North Carolina, Oklahoma, Texas, West Virginia and Wisconsin's bans all have pre-Roe v Wade laws that became unenforceable after the Supreme Court's 1973 decision - that would kick into effect if the federal legal precedent established in Roe were overturned.

Alabama, Arizona, Michigan, Mississippi, Oklahoma, West Virginia and Wisconsin's laws allow for abortions if the patient's life is in danger.

Alabama also allows for abortions in order to preserve the health of the patient.

Arkansas, Oklahoma, Mississippi and Texas have further bans that will come into effect if the law was overturned. These were passed post-Roe v Wade.

They're joined by Idaho, Kentucky, Louisiana, Missouri, North Dakota, South Dakota, Tennessee, Utah and Wyoming, in passing such laws.

The Oklahoma legislature just passed a six-week abortion ban, similar to Texas, in April 2022. Similar to the Texas law, it allows for the state to file lawsuits against those who are found to have helped someone to get an abortion after the six-week period.

Oklahoma Governor Kevin Stitt said in September 2021 tweet, 'I promised Oklahomans I would sign every piece of pro-life legislation that came across my desk.'

The states that will limit abortions based on the length of time a patient has been pregnant are Arkansas, Kansas, Kentucky, Louisiana, Missouri, North Dakota and Ohio.

There are four states that have laws that believe that abortion is not a constitutionally protected right are Alabama, Louisiana, Texas and West Virginia.

There's plenty of them, textualist/originalist theory is the biggest crock of inconsistently applied sh*t.

Thomas' decisions can basically be summed up as "we absolutely must adhere to precedent.....unless I don't like it in which case we should absolutely overturn precedent."
