You're only half right. Yes, Weird Al seeks permission to parody others songs. But the thing is, that doesn't mean he can't. Weird Al's just a nice guy. If he wanted to, he could just say "fu*k it" and do the parodies anyway. But he ain't like that.

Thats not what that means.

It means that ANYBODY can record a parody. The records that rappers do on mixtapes (when they get on somebody else's beat) are legally considered "Parodies". Thats why they can do it. So long as they're not SELLING it for profit.

It's the same thing as when Drake release "So Far Gone" as an album. Why he had to cut all the tracks he couldn't get clearance on.

If you plan on making money on something (as Trojan does), they have to get clearance. Otherwise the artist and label will sue you for their cut.

Thats why the solution to the Weird Al/Lady Gaga dispute was hit just releasing the song for free on youtube (the home of profitless parodies)
