Barr says Trump administration can legally add citizenship question to census

Attorney General William Barr said Monday that he believes the Trump administration can legally add a citizenship question to the 2020 census, though the Supreme Court ruled against its inclusion last month.

In an interview with The a*sociated Press, Barr said he has been in regular contact with President Trump about the question, which the president is determined to see featured on the decennial survey.

“I agree with him that the Supreme Court decision was wrong,” Barr told the AP. The attorney general added that he thinks there is “an opportunity potentially to cure the lack of clarity that was the problem and we might as well take a shot at doing that.”

Barr declined to provide further details to the wire service on how the question will be added to the census.

However, the AP cited a senior official who said President Trump is expected to issue a presidential memorandum to the Commerce Department directing it to include the citizenship question on the 2020 census. Action is expected to be taken in the coming days.

The Hill has reached out to the Justice and Commerce departments for further comment.

The Supreme Court, in a 5-4 ruling last month, found that the administration's stated reason for adding the citizenship question to the census didn’t match up with the evidence in the case.

The justices blocked the question from appearing on the survey for the time being but left an opening for the Commerce Department to provide another reason for the question’s inclusion. The Trump administration had claimed the question was necessary to enforce the Voting Rights Act.

Opponents of the question argued that its inclusion on the census would lead to an inaccurate count of the population, as immigrants might be discouraged from participating. The Department of Justice (DOJ) had argued that the data would not be used for purposes beyond compliance with the voting law, but critics said the perception was enough to cause individuals to skip the question or the survey altogether.

[b]The DOJ initially appeared ready to accept defeat in the legal battles, announcing Tuesday that census materials would be printed without the question. The administration had said in court filings that census materials needed to be finalized by June 30 for a July 1 printing deadline.

But Trump one day later tweeted that those efforts would move forward, appearing to catch even DOJ lawyers on the case by surprise.

“The tweet this morning was the first I had heard of the president's position on this issue, just like the plaintiffs and Your Honor. I do not have a deeper understanding of what that means at this juncture other than what the president has tweeted,” Joshua Gardner, a DOJ attorney, told a federal judge during a teleconference Wednesday.

“But obviously, as you can imagine, I am doing my absolute best to figure out what's going on,” he added.

The DOJ also announced late Sunday that it was pulling its entire legal team for the citizenship question off the case, and replacing them with other government lawyers.

That move has fueled speculation that career DOJ lawyers refused to provide another rationale behind the citizenship question after repeatedly citing the Voting Rights Act in court or [u]that officials feared they would no longer be viewed as trustworthy by judges presiding over the cases.[WTF?!]

Yesterday, as Matt covered, Attorney General Bill Barr announced he has found a way through the Department of Justice to keep a question about citizenship status on the 2020 census.

Now the left, who thought they took home a victory when the Supreme Court pushed the matter back to the lower courts two weeks ago, is having a meltdown.

House Speaker Nancy Pelosi is leading the way, arguing the only reason President Trump wants the question included is to "make America white again."

"This is about keeping, you know, make America, you know this hat Make America White Again. They want to make sure that people, certain people, are counted. It's really disgraceful and it's not what our founders had in mind. What they want to do is put a chilling effect so certain populations will not answer the form, that they won't answer the form, that they won't respond," she said. "Don't give them that victory. You must respond because otherwise, they win."

Funny Pelosi would mention voters. The U.S. Census is used to count the population of the United States. Those numbers are then used to allocated Congressional seats. It's no wonder why Democrats don't want more than 22 million illegal aliens knowingly questioned in the survey. From Census.gov:

For the record, the Supreme Court did say the Trump administration has the legal authority to include a citizenship question on the census, but the majority argued lawyers for the Commerce Department did not adequately explain why it was being included.

The Court did not find the question to be a violation of the law, but instead didn't receive enough information from the Commerce Department and Secretary Wilbur Ross to make a decision. This leaves the door open for the citizenship question to be included on the census in the future.

Conservative justices ripped the opinion and argued the explanation is irrelevant.

Meanwhile Justices Clarence Thomas, Brett Kavanaugh and Neil Gorsuch argue in their dissent the Supreme Court's only role was to determine whether Commerce Secretary Ross was breaking the law by including a question about citizenship. The court found he did not break the law in doing so.

"The Court’s erroneous decision in this case is bad enough, as it unjustifiably interferes with the 2020 census. But the implications of today’s decision are broader. With today’s decision, the Court has opened a Pandora’s box of pretext-based challenges in administrative law," they wrote. "In short, today’s decision is a departure from traditional principles of administrative law. Hopefully it comes to be understood as an aberration—a ticket good for this day and this train only."

"Because the Secretary’s decision to reinstate a citizenship question on the 2020 census was legally sound and a reasoned exercise of his broad discretion, I respectfully dissent from Part V of the opinion of the Court," they concluded.

Federal Judge Blocks Justice Department’s Effort to Withdraw Lawyers on Census Citizenship Case

The Justice Department tried to withdraw its legal team amid a battle over adding a citizenship question to the 2020 census. A federal judge denied the request.

WASHINGTON — A federal judge in New York on Tuesday rejected the Justice Department’s request to switch its legal team midway through a case challenging the Trump administration’s effort to add a citizenship question to the 2020 census.


The sharply worded order, by United States District Judge Jesse M. Furman, may further hobble an already struggling battle by the administration to save the citizenship question. Efforts to block it have become a crucial political issue as the next census — and the redrawing of political boundaries in 2021 that will use fresh census data — draws near.

On Sunday, the Justice Department said it was replacing the legal team defending the citizenship question. It offered no explanation for the change, which came in the middle of a prolonged clash over whether the administration’s arguments for adding the question could be believed.

But on Tuesday, as a new team of lawyers began to notify the court of its appearance in the case, Judge Furman barred the old lawyers from leaving until they met a legal requirement to satisfactorily explain their departure and show that it would not impede the case. He excepted only two lawyers on the team who had already left the department’s civil division, which was overseeing the lawsuit.


“Defendants provide no reasons, let alone ‘satisfactory reasons,’ for the substitution of counsel,” he wrote, adding that their written a*surance that the switch would not disrupt the case “is not good enough.”

If the department wishes to continue with the switch of legal teams, the judge wrote, the lawyers must provide sworn affidavits explaining their departures and remain under the court’s jurisdiction should they be required to return.


The American Civil Liberties Union and other plaintiffs led by New York Attorney General Letitia James had asked the judge on Monday to block the Justice Department’s reassignment of the case without providing a reason for the withdrawal. On Tuesday the group said it still had questions about the move.

“The Justice Department owes the public and the courts an explanation for its unprecedented substitution of the entire legal team that has been working on this case,” said Dale Ho, the A.C.L.U.’s lead attorney on the case. “The Trump administration is acting like it has something to hide, and we won’t rest until we know the truth.”

On its face, Judge Furman’s order only enforces a court rule governing changes of legal counsel. Practically, however, it presents the department with a difficult choice: Either reverse course and leave its old legal team in place, or produce sworn explanations that could prove both embarrassing and damaging to the administration’s case.

The department’s legal campaign had already undergone head-snapping changes in strategy this month. Department lawyers first said they were abandoning the case in the face of a Supreme Court ruling blocking the question, only to reverse course the next day, after President Trump called their statement “fake” and said the case would continue. They then told a federal judge that the administration was exploring a “legally available path” to restoring the question.

But that handed opponents of the citizenship question a legal opening: In a motion in Judge Furman’s court last week, they argued that the government had repeatedly said the lawsuit had to be resolved by June 30, when the printing of the 2020 census forms had to begin. The department’s announcement that it would continue to press for the question in July belied that explanation, opposition lawyers said.

They also suggested that the administration had set a false deadline for resolving the case to keep opponents from uncovering evidence that the citizenship question had been driven by a desire to help the Republican Party gain power when census figures are used to draw new political boundaries in 2021. The challengers said they would pursue sanctions against the defense for its conduct.

The Justice Department announced the switch in legal teams two days later on Sunday. While the department has not explained the change, multiple people familiar with the case have said that the lawyers resigned from the lawsuit out of ethical concerns and a belief that the suit was unwinnable.

Those people have said that many of the lawyers did not see a path forward on the case, given that any argument they made could appear to contradict statements to district judges and to the Supreme Court that the administration had to have a decision by June 30. Just as important, they faced a conflict of interest in trying to represent a client — the President of the United States — who had just publicly branded them liars.

But if those explanations were presented to Judge Furman, they would undermine any future arguments made by the Trump administration as it continues to find a way to put the citizenship question onto the census.

“They are absolutely in a bind,” said Neal Katyal, a partner at Hogan Lovells and the former acting solicitor general. “They can’t answer the question without gutting what Trump and Barr are trying to do. They can try to avoid being forthcoming, which is increasingly the modus operandi of Trump’s Justice Department. But that move will fail in the courts, as today’s decision indicates.”

The census f*ght has become an embarrassing issue for the Justice Department.

William Barr, the attorney general, told The New York Times on Monday that he believed the department could find a legal path to adding the citizenship question to the census.

Mr. Barr also said he believed the team that had worked on the census question through the Supreme Court ruling had done exemplary work. He added that he had heard from James Burnham, who had been in charge of the case, that a number of lawyers who had been working on the census issue for a long time “probably prefer not to stay at this new phase in the litigation.”

“We decided not to put them in that position,” Mr. Barr said.




So either more DOJ employees are committing treason or just winging it, and completely sabotaging this census f*ght and won't be allowed to be replaced by new blood bc the decision is the one they prefer, as does the Obama Judge? This is straight crazy.

If the question doesn't appear on the census, they still plan on circumventing the census for other avenues of getting that information.

I fail to see how I look like a fool? For believing an Obama appointed judge won't be fukking biased (Ethical Violation), or for believing they had a different set plan which wasn't allowed to be pursued by the DOJ by this same judge? Nothing I said was a lie, it just didn't materialize. It was worth a shot, and had they had more time, this could have played out different. Pat yourself on the back for absolutely nothing. I don't see how you can even gloat, when I didn't make that up out of thin air.
