What failed? The resolution passed lmao. I don't think you fully understand the implications of a resolution in this case... regardless of whether or not it was passed with a 2/3 majority...


When the President takes measures incompatible with the expressed or implied will of Congress, his power is at its lowest ebb, for then he can rely only upon his own constitutional powers minus any constitutional powers of Congress over the matter. Courts can sustain exclusive presidential control in such a case only by disabling [343 U.S. 579, 638] the Congress from acting upon the subject. Presidential claim to a power at once so conclusive and preclusive must be scrutinized with caution, for what is at stake is the equilibrium established by our constitutional system.

This resolution was an expressed will of congress, none of the president's constitutional powers allow him to spend money not allocated to him by congress. Even if you cite the National Emergency Act, Congress has expressly said that the president may not declare a national emergency in this case.

The only way this wins in SCOTUS is if all of the conservative justices decide to ignore this longstanding precedent. Now I'm not sure if you know how conservative jurisprudence works...but the long and short of it is basically that conservatives hate to change precedent or adopt new rules. Sooooo yeah...
