Suing for what? A verbal altercation that witnesses and video, security said you said some racist sh*t and got checked and turned into a whole how like most of these white supremacists are. (a former white supremacists on Reddit said it himself, and a Netflix documentary interviewing my enemy or something like that they said it themselves there too) good luck with that f*g**t.

So many non lawyers trying to make legal arguments. What exactly are his damages? What's his cause of action? Dude was on tv an hour after thime incident talking about it calmly. At best he can try and recoup his season tickets(if he had them for the reminder of the season do that's a few games) club refunds next years tickets and he's been made whole. This is so fu*king stupid to think he's actually got a case.
welcome to america u can sue for anything. we had a guy in detroit over here that broke into a liquor store from the roof fell broke his leg and sued the store and won so just think about that one

:r ofl:
What you're describing is a personal injury suit, this would be his cause of action. His damages would be his broken leg, and any lost income as a result of said injury. Now I'm doubtful this was a judgment from a court, and most likely a settlement (which is often cheaper than litigation). As stated before there was a cause of action and damages in the anecdotal scenario you describe, which I can't confirm. In this situation there are literally no damages, and there's no cause of action. This lawsuit if real will go absolutely nowhere.

He'd have to link the fake tweets to Westbrook which he can't. His teammates will back his version of the events, challenging someone to a f*ght is not The basis for a civil suit. He suffered no mental anguish as a result of the incident as demonstrated by his interview after The game. Everything that happened after the can't beer linked to Westbrook. The league and the player's a*sociation would back Westbrooks defense in any civil suit, neither is gonna allow for its members or players to be held liable for something like this, sets a terrible precedent.

he doesn't have to link the tweets to Westbrook. All he has to do is say Westbrook put the idea of him being racist out there for the fake tweets to exists in the first place.

And you also can't say he didn't suffer mentally, his name was dragged through the mud on social media, scared for his life because he was doxxed, etc. He could easily play the victim here.

Wait I read the comments on here but all the dude said was get on your knees?

That’s not racist..

On one hand I wanna say the fans should be able to talk sh*t AT GAMES because that’s one of the benefits of home court advantage... fans rattling the players heads... but on the other hand the fans can’t be acting like these athletes are zoo animals.

If it was off the court I woulda agreed with Russ slapping the sh*t out of dude but on the court if he just blurted that out. I don’t know.

fu*k that lawsuit though. Off that ima agree with Russ. bi*ch a*s fan trying to clip this dude because Russ didn’t play no games with him.

What you're referring to is called negligent infliction of emotional distress. Multiple problems with this cause of action: first he gave an interview shortly after the interview and was clearly suffering from 0 negative issues relating to the confrontation; two there is absolutely no connection between Westbrook and what the internet decided to do to him after did interview; and any nexus between the event and the things that happened to him after are too attenuated.

You're funny, Westbrook merely quoted him. Truth is the ultimate defense to slander. So when his teammates back his version of the events, this guy will have to prove Westbrook was acting in bad faith when he quoted him. Good luck with that
Westbrook: I genuinely believe that I heard him say get on your knees like you used to.

CASE CLOSED

Witness testimonies are some of the most unreliable types of evidence, they get tossed out all the time. They can also easily claim bias.

The guy also said what westbrook said was false, it's a loud arena he can easily claim Westbrook misheard him.

It's easy to make the case for the guy, the suit might go to court, don't be surprised

You literally just made my point for me. If Westbrook misheard him, yet had an honest belief that he heard what he heard there's 0 negligence, and 0 bad faith. Look think what you want, you're not a lawyer so going back and forth with you on a subject in which you lack expertise is a waste of both our time.
Slander/Liebel
First, the plaintiff must prove that the defendant made a false and defamatory statement concerning the plaintiff.
Second, the plaintiff must prove that the defendant made an unprivileged publication to a third party.
Third, the plaintiff must prove that the publisher acted at least negligently in publishing the communication.
Fourth, in some cases, the plaintiff must prove special damages.

Never gonna get over that third element kid
Also you're referring to eye witness testimony not witness testimony in general. Literally the only way evidence comes into a trial is through witness testimony.
